Regulatory Analysis

The expertise of regulatory and scientific staff enables ESD to provide a complete range of services and products to managers and other professionals in the area of environmental regulatory analysis and compliance, including tracking of federal and state ESH rulemaking.  These comprehensive capabilities translate into time and cost savings to projects required to be in compliance with federal and state environmental laws and regulations.   ESD provides regulatory support to the U.S. Army for their environmental programs­­ on the determina­tion, descrip­tion, and interpreta­tion of ARARs (Applicable or Relevant and Appropriate Requirements) and ARAR support documentation for interim and final remedial and removal actions at active and base realignment and closure (BRAC) sites.  Staff also serve in an oversight capacity performing analyses and review of regulatory issues on a programmatic level including serving on the Army’s Independent Technical Review Panel.  These tasks require the identification and justification of all legal and regulatory requirements of RCRA, TSCA, CWA, NEPA, CAA, UST, UIC, and comparable state regulations.  To date, ESD has provided this support for 67 installations in 31 states.  ESD has also provided regulatory support to DOE, the Army Corps of Engineers, the Nuclear Regulatory Commission Office of State Programs, and EPA.
